Successful $800,000 Income Protection Claim for Mental Health Exclusion

Recently, I secured an $800,000 settlement for a client whose income protection insurer had unfairly added a mental health exclusion, claiming non-disclosure of prior treatment. This client had previously sought help from another law firm that, along with a barrister, advised him against challenging the insurer. They also refused to pursue two TPD claims on his behalf.
I disagreed with this approach and recommended taking the case to court. The outcome was a complete success: not only did we win the income protection claim, but I also settled a litigated retail TPD policy, secured approval for his super TPD claim, and ensured he receives monthly income protection payments for the next 28 years.
The client was thrilled with the results.
